Re: [californiadisasters] Re: Admin Read: Fair Use

Dan,

Yes, the Leftist rag known as the LA Times took on the Right-Wing rag known as the Free Republic with both rags being for-profit and having large circulations. In other words, the Culture War was being fought disguised as a copyright legal brawl. In the end as you point out money didn't even change hands but it ended up being essentially a "cease & desist" order. That was 11 years ago and in the meantime Yahoo Groups and many other online forums and lists have popped up with nary a legal precedent or even legal problem as it pertains to such repostings.

It couldn't be more clearly stated via their own actions that copyright holders aren't being kept up sleepless at night thinking about repostings on Yahoo Groups and other such forums. They go where other people's money is or where they own money might go and small non-profit discussion forums don't justify them hiring lawyers for several hundred dollars an hour to chase after where there is no money and no real threat to their profitably. Copyright holders intelligently follow the principal of the cost-benefit ratio.

We are nothing to them. End of story. In any case we are adapting to Steve Rule just be on the safe side.

Speaking of the LA Times, the newspaper did take the on-line Free Republic to court several years ago. The Washington Post also did at the same time. The case was settled by FR agreeing not to post complete articles on the website (the same rule applies to their members). They post links only. The vast majority of the news groups I subscribe to do the same, and do not allow members to post complete articles.
