With any lawsuit, the determining issue in bringing action is the "profit" from the republication of the copyrighted piece.  If there is no monetary gain there is a real problem in determining "damages".  If there are none, then the courts have found there is no "standing" for a case, and the actions are usually dismissed.  So putting simply,  if there is no harm done, there is NO CASE.
