Evacuation Warning Issued for the Grant Grove Area ofKings Canyon National Park

SEQUOIA AND KINGS CANYON NATIONAL PARKS, Calif., September 8, 2015 – In response to the current conditions on the Rough Fire, burning in Kings Canyon National Park and the Sierra and Sequoia national forests, the National Park Service is issuing an Evacuation Warning to park employees, concessions staff, residents of Wilsonia, and park visitors in the Grant Grove area north of the junction of Hwy. 180 and the Generals Highway (sometimes referred to as Hwy. 198). The National Park Service is working with the Sheriff's Departments of both Fresno County and Tulare County to provide the warning notifications. An Evacuation Warning is defined as, "Alerting of community members in a defined area of a potential threat to life and property from an emergency incident. An Evacuation Warning may be issued when the potential or actual threat to civilian life is more than 2 hours away." Currently, there is no immediate threat to Grant Grove, however with the recent fire behavior that has been observed over the past several days, the park management in cooperation with the Rough Fire Incident Management Team believes that the fire could make significant movement in that direction in the near future. Friday evening, July 31st, 2015, a forest fire began on the Sierra National Forest east of Hume Lake. 

It started out in a relatively remote area and with so many other fires burning in the state it was not a high priority until it threatened Hume Lake Christian Conference Center and destroyed a nearby roadside lodge. 

At over 95,000 acres as of this morning before this afternoon's burning period this is the largest active fire in the state with only 31% containment. 

Today was a rough day on the Rough Fire as it jumped containment in the worst place possible with an initial 200-acre slop-over while smoked in so no aircraft could fly to drop on it. 

This evening the Fresno County Sheriff's Department has issued this bulletin: 
  

Rough Fire Causes Mandatory Evacuation Notices to be Issued

Due to changing conditions of the Rough Fire, the Fresno County Sheriff's Office is informing the public that effective immediately, mandatory evacuation notices are being issued to certain residents near where the Rough Fire is burning. This is a fluid situation and there is no time table for when these mandatory evacuations will be lifted.

The impacted area is to the north of the Highway 180 / Millwood Road intersection in Dunlap. More specifically, we are focusing on the area of U.S. Forest Service Road 12S01 and Sampson Flat Road as the most southern point. The community of Crabtree is the most northern point. The western border is U.S. Forest Service Road 12S19 and the eastern border is Cherry Gap, which is near the intersection of U.S. Forest Service Road 13S03 / Hwy. 180.

The principle of evacuation is to move citizens from a place of relative danger to a place of relative safety, via a route that does not pose significant danger. Below is an explanation to common legal concerns during these circumstances.

According to Penal Code Section 409.5 (c), any unauthorized person who willfully and knowingly enters an area closed pursuant to subdivision (a) or (b) and who willfully remains within the area after receiving notice to evacuate or leave shall be guilty of a misdemeanor.

This misdemeanor occurs only if a person both enters a closed disaster area knowing it to be closed and subsequently refuses to leave when ordered to do so.

No crime is committed by a person occupying his or her home prior to the closing of the area and subsequently refuses to leave when ordered to do so.

While it is evident that PC 409.5 contains the authority to dissuade persons from entering an area designated as an emergency area, it cannot be used to mandate persons into leaving their residence. The overriding concern of the Fresno County Sheriff's Office is the safety of its citizens in the unincorporated areas
