Re: [californiadisasters] San Bernardino Mass Shooting Situation Report #1 (Dec 2)

For the uninformed, here is something that was beaten into us in cop school (daily):

Motive is NOT an element of any crime.  Not a single one.

Intent is, motive is not.  It's a subtle difference.

Intent is WHAT the perp planned to do; motive is WHY (it doesn't apply to the crime).  For example, trespass (a misdemeanor) becomes burglary (felony) if the INTENT is to commit a theft.

Motive is what folks want to know to answer the eternal question: "Why?" But it is not a crime element.

Now if those weevils known as reporters could get the hint... Motive; nice to know, but not a legal issue except for jury sentencing much later.

San Bernardino Mass Shooting Situation Report #1 (Dec 2)

Highlights:

·         A total of 14 people have been killed and 17 injured.

·         The San Bernardino Police Chief reported that they have found explosive devices in the Inland Operations Center so they are still in the process of conducting a search.

·         The investigation into the shooting led to police to a house in the City of Redlands.  Police observed a vehicle leaving so they pursued the vehicle back to the City of San Bernardino.

·         The suspects opened fire on police and one officer was wounded.  Both suspects (male and female) were killed.  The suspects were dressed in tactical clothing.

·         The motive for the shooting is still in question.  They have not ruled out terrorism.

·         An individual was seen fleeing the scene and that individual was detained and police are investigating if they were involved in the shooting.
